Terms & Conditions of Sales Scope of
Application on installing a AIL-TDCL product for the first time, the user
accepts the terms of the AIL-TDCL End-User License Agreement . These Terms
& Conditions of Sales constitute the agreement between AIL-TDCL ("We") and
anyone considering or making a purchase (the "Customer" or "You") of the
registration numbers required to unlock the versions of AIL-TDCL products.
These Terms & Conditions of Sales may be modified at any time, the
applicable conditions are those published on the Website at the date of
purchase.
Pricing Prices quoted on our Web site are valid at
the time of ordering. They are indicated and invoiced in UK pounds. VAT is
included in our prices where stated.
Delivery A license
number & CD-ROM or packaged version of the software will be sent by postal
mail once the payment is received and accepted. A CD-ROM, a registration number
and an invoice will be sent to the address indicated by the customer at the
time of purchase. To prevent possible lost of data, we advise our Customers to
save their license number and invoice upon
receipt.
Returns All AIL-TDCL software is supplied in sealed
packages and cannot be returned for refund if the seals are broken, tampered
with or damaged. We accept returns only if software is still factory sealed and
boxed, returns cannot be accepted for opened software, as the product licence
key has been exposed. If you need to return any purchase as a result of your
incorrectly purchasing an item, we reserve the right to levy a 20% restocking
fee, and all delivery charges are non-refundable. Should you need to return an
item, please ensure you contact us beforehand, so that we can authorise the
return.
Restitution Right The right of restitution does not
apply in the event of the sale of serial numbers required for the release of
the demo- versions of the software. Payments are only considered to be firm and
final. There cannot be any exchange or refund.
Privacy We
receive and store all information you enter on our Web site or give us in any
other way. We will not use or disclose any personal information obtained from
you for anything else other than account-management purposes and communications
with you. We may contact you by email to inform you about new products, updates
or services when available. If you do not want to receive such notifications,
send us your request using the Enquiry Form with your full name and email
address.
Your Obligations You commit yourself to: Provide
reliable information about yourself Agree with these Terms & Conditions of
Sales Respect the terms of the AIL-TDCL End-User License Agreement attached to
the product. It is your responsibility to ensure that you have carefully
checked the details of your Order. Any non respect to your obligations may
result in the permanent loss of your rights to use the delivered license(s)
from AIL-TDCL, including services supplied with the licence(s).
Limitation of Liability Although We try to correct all errors or
omissions as soon as possible once they have been brought to Our attention, We
do not guarantee that Our software will be available and in a fully operating
condition nor that the information provided by AIL-TDCL will be free of errors
or omissions. AIL-TDCL company cannot be held responsible for any complaints
and/or any proceedings regarding the usage of the AIl-TDCL products. The
customer must protect himself from the loss of data. Because a new installation
or a modified installation of the software might create a risk of loss of data,
the customer must secure the data by all means available.
Communication As far as the contracting partners communicate by
Email or through our Web site, they acknowledge the unlimited value of the
declaration of intention, transmitted by these means, in accordance with the
following regulations. In an Email or through our Website, normal statements
cannot be suppressed or modified to make them anonymous. The statements must
indicate the Email addresses of the senders, the dates and hours of dispatch
and, at their end, a repetition of the senders' names. An Email received in
accordance with these regulations will be considered as being sent by the other
partner provided that no proof to the contrary is furnished. All messages
transmitted to AIL-TDCL must be written in English.
Cession of
Claims The customer is not allowed to assign or transfer rights and
obligations arising from this contract
Validation You
acknowledge that you have read and accepted the order conditions, the
information about the characteristics of the products or services ordered, the
price, delivery, the conditions of use of the license as well as the General
sales conditions before placing your order. The contract is created once the
customer has purchased the software and AIL-TDCL acknowledged and proceeded
with the order. Data stored by the AIL-TDCL company are the proof of all
transactions between the company and its customers.
Commercial and
Legal Domicile Commercial domicile for the performance of the
contracting parties is the registered seat of AIL-TDCL, England. The legal
domicile is agreed to be the court competent for the place of performance, if
the customer is a tradesman, a legal person or special institution by public
law or if he does not have a general venue in the UK. The contracting parties
agree, that all legal relations of this contract now and after fulfillment of
the contract shall be construed and enforced in accordance with UK law.
